Carriers who were operating before 2020 often missed the requirement entirely. Carriers who do know about it frequently skip the annual limited query for existing drivers which is just as required as the pre-employment full query.
What Does the Clearinghouse Actually Track?
The Clearinghouse contains records of the following violations for CDL drivers:
- Positive drug or alcohol test results
- Refusals to take a required test (refusal is treated the same as a positive)
- Actual knowledge violations when an employer has direct knowledge a driver used drugs or alcohol
- Return-to-duty test results
- Follow-up testing completion records
The database is national and permanent within its retention window. A violation a driver received at a carrier in Texas is fully visible to a carrier hiring them in Oregon.

Step-by-Step: How to Query the Clearinghouse
- Register your company at clearinghouse.fmcsa.dot.gov. You will need your USDOT number. Registration is free and takes about 15 minutes.
- For a pre-employment full query: Search the driver's CDL number and state. The system will send the driver a consent request. Once they consent electronically, you can view the full record. If there is a violation, do not allow the driver to operate until it is resolved.
- For annual limited queries: You can batch-query all active drivers. No consent is required. If the system returns "violation exists," you must then run a full query (which does require consent) to see the details.
- Document every query. Keep a record of the query date, driver, and result in the driver's qualification file. This is what auditors check.
What Happens If You Hire a Driver With a Clearinghouse Violation?
If a driver has an unresolved violation in the Clearinghouse and you allow them to operate a CMV, you are in violation regardless of whether you knew. The legal standard is that you were required to query, and the query would have told you. Ignorance is not a defense.
The consequence is a citation during your next DOT audit, a potential fine, and the violation contributing to your Driver Fitness BASIC score. In a crash situation, a plaintiff attorney finding that you employed a driver with an unresolved Clearinghouse violation is significant evidence of negligent hiring.
What Carriers Get Wrong Most Often
- Not running the annual limited query. Pre-employment queries are better understood it's the annual requirement for existing drivers that gets missed most consistently.
- Not documenting queries in DQ files. Running the query is not enough the result needs to be on file.
- Hiring before consent is received. Some carriers run the pre-employment query, the driver delays giving consent, and the carrier lets them start driving anyway. This is a violation.
- Not registering at all. Carriers who set up their operation before 2020 and have not updated their compliance program sometimes have no Clearinghouse account whatsoever.
